TERMS AND CONDITIONS OF ONLINE TRANSMISSION PURCHASES
FROM BROADWAY TRANSMISSION & MORE (BTM)
1. WARRANTY. Installer must call BTM @ 717-244-1415 before installation. A
BTM technical advisor will assist you with proper procedures for your
transmission model and gather data on the vehicle being worked on. BTM
warrants their remanufactured transmissions and torque converters for a
period of 18 months or 18000 miles whichever comes first. Longer warranties
are available at an additional cost and may be purchased up to the date of
installation.
Installation of the transmission without first calling BTM and following
proper installation techniques will void this warranty. Electronics are not
covered under this warranty. Proper manufacturer-recommended maintenance
must be done to keep warranty in force. Under normal use, the transmission,
torque converter, and internal mechanical parts found to be faulty due to
workmanship or defective part will be the limit of what is covered under
this warranty. This warranty does not cover shipping or labor costs incurred
in diagnosis or replacement of any defective product, nor does it cover any
other contingent or consequential damages or expenses.
BTM takes every precaution to insure a top quality product. Nonetheless,
transmissions can be ruined by improper installation, wrong initial
diagnosis of needing a transmission, towing or hauling above vehicles
design, lack of cooling or flow of transmission fluid through a cooling
system, water contamination, electrolysis, corrosion, etc. BTM does not
warrant any product damaged because of circumstances beyond their control.
All warranty claims must be verified as to the fault before BTM will make
restitution.
2. CORE POLICY. In order for BTM to have their products available on an
exchange basis they must have the transmission cores returned to them. It is
the customer's responsibility to:
1. Remove any parts not included with the core exchanged
2. Drain completely all fluids from transmission and converter
3. Return all shipping straps and hardware as it was sent
4. Correctly complete return tag and warranty forms
If the core is received by BTM within 30 days of invoice, the core charge as
itemized on the online Order Summary will be refunded to your credit card or
pay-pal account. Only cores that do not have holes in the case will receive
a full refund of core charge. Core charges will be refunded within 14
calendar days of receipt of returned and checked core.
3. PRICING. BTM makes every effort to assure that the order and pricing data
is 100% accurate. However, if the price in your order is inaccurate due to a
technical error or price change, you will be notified prior to shipping.
Limit of liability shall be 100% refund only in the event of error in
pricing.
4. SHIPPING POLICY. All orders are checked and verified before final
shipment is made. Shipment usually takes place within 48 hours of order
completion. All shipping is done at the customer's expense and is included
in final cost. Shipping costs may change due to changing costs of fuel etc;
and a final cost of total shipping may vary slightly. A BTM representative
will contact you with a final cost if different than the one shown in the
online Order Summary. BTM assumes no responsibility for any additional cost
of shipping if customer orders the wrong product. Shipping is not available
to Alaska and Hawaii.
5. OTHER POLICIES. This transaction shall be governed by and enforced in
accordance with the laws of the Commonwealth of Pennsylvania and any
litigation regarding this transaction may only be brought in the county of
York, Pennsylvania. In the event any litigation is brought in any other
forum, BTM, shall be entitled to reimbursement of all costs and expenses
incurred including reasonable attorney fees in defending place of proper
jurisdiction.
6. RETURN POLICY. All sales are subject to a restocking/handling fee of 20%
if the customer returns a transmission in verifiable good condition. BTM
does not give cash refunds.
